회복적 정의의 비판적 검토 - 신로마 공화주의를 중심으로 -
본 연구는 죄를 저지른 대가에 그치는 응보적 정의를 넘어서 가해자 의 뉘우침과 피해자의 용서에 기반을 둔 회복적 정의를 논의하고자 한 다. 한편, 회복적 정의에는 기독교와 신로마 공화주의에 토대를 둔 두 개념으로 분류할 수 있다. 기독교에 입각한 회복적 정의는 우리 사회 에서 가장 유력한 이론으로 간주되었지만, 동조현상으로 인한 문제가 꾸준히 지적되었다. 이에 본 연구는 신로마 공화주의에 입각한 회복적 정의를 도덕과 교육에서 적합한 이론으로 제시하였다. 신로마 공화주 의는 각 시민의 존엄한 평등과 권리를 지키기 위한 수단으로서 개념을 제시하고 있기 때문이다. 나아가 신로마 공화주의에 입각한 회복적 정 의가 도덕과에서 추구하는 공동체 모델로 내세우고자 한다.
A Critical Review on the Concept of Restorative Justice - Focus on neo-Roman Republicanism -
The purpose of this study is to investigate the meaning of restorative justice and to discuss the implications of moral education. Restorative justice is a theory that helps to build an offender-victim relationship. Meanwhile, restorative justice can be classified into two concepts based on Christianity and neo-Roman Republicanism, and currently, the concept of restorative justice in Korea is accepted as the concept of 'Restorative Discipline'. This is a case in which only the restorative justice based on Christianity has been focused and discussed. Therefore, this researcher indicated that it is necessary to access the restorative justice based on Christianity and the restorative justice based on neo-Roman Republicanism differently. On the basis of these three reasons, this study has a significance in pursuing a restorative justice as a community definition, rather than through penology, which is meaningful in that it suggests a new concept of justice in moral education.
