현대의 정의론 고찰 - R. Nozick의 Anarchy, State, and Utopia를 중심으로 -
정의(正義)는 도덕과 교육과정의 핵심 가치로서, 초등학교부터 고등학교까지 내용 요소로 설정되어 있다. 2015 교육과정에 따라 개발된 고등학교 ‘생활과 윤리’ 교과서의 분배적 정의 관련 진술을 살펴보면, 롤스와 노직의 주장이 공통적으로 비교 설명되어 있다. 롤스의 주장에 관한 연구에 비해 노직의 주장에 관한 연구는 상대적으로 적은 편이다. 이에 본고에서는 ‘생활과 윤리’의 관련 학습 내용지도에 도움을 주기 위해, 정의에 관한 노직의 주장을 그의 저서『아나키, 국가 그리고 유토피아』(Anarchy, State, and Utopia, 1974)를 중심으로 살펴보고자 한다. 총 3부 10장으로 구성된 이 책에서 노직은, 권리의 주체는 개인이며 그 권리는 매우 강력하다는논변, 자연 상태로부터 최소 국가가 등장하는 과정과 최소 국가가도덕적으로 정당하다는 논변, 소유권적 정의에 관한 논변, 최소 국가가 유토피아의 토대를 제공한다는 논변을 펼치고 있다.
The Contemporary Theory of Justice - R. Nozick’s Anarchy, State, and Utopia -
This paper reviewed the arguments on justice of Robert Nozick’s Anarchy, State, and Utopia(1974). He argues that individuals have right, and there are things no person or group may do to them (without violating their rights); that the state are that minimal state, limited to the narrow functions of protection against force, theft, fraud, enforcement of contracts, and so on, is justified; that any more extensive state will violate persons’ rights not to be forced to do certain things, and is unjustified; that the state may not use its coercive apparatus for the purpose of getting some citizens to aid others, or in order to prohibit activities to people for their own good or protection; that as the framework for utopia the minimal state is inspiring well as right.
